(How the new Virginia anti-spam legislation favors Bulk-it members)

Once there was a princes who owned a pet frog that accidentally fell into well. The princes heard the frog ribit-ting- or whatever frogs do when they fall into wells. After carefully assessing the situation, the princes sympathized with the frog , but decided that neither the frog nor the well was worth the trouble of saving.

Instead, she called her servants together and told them what had happened...and enlisted them to help haul dirt to bury the frog in the well and put him out of his misery.

Initially, the frog was hysterical! But as the princes and her servants continued shoveling and the dirt hit the frog's back...a thought struck him. It suddenly dawned on him that every time a shovel load of dirt landed on his back...HE SHOULD SHAKE IT OFF AND STEP UP! This the frog did, scoop after scoop.

"Shake it off and step up...shake it off and step up...shake it off and step up!" the frog repeated to encourage himself. No matter how painful the dirt, or distressing the situation seemed, the frog fought "panic" and just kept right on SHAKING IT OFF AND STEPPING UP!

You're right! It wasn't long before the frog, battered and exhausted, STEPPED TRIUMPHANTLY OVER THE WALL OF THAT WELL! What seemed like it would bury him, actually blessed him...all because of the manner in which he handled his adversity.

THAT'S LIFE! If we face our problems and respond to them positively, and refuse to give in to panic, bitterness, or self-pity...the adversities that come along to bury us usually have within them, the potential to benefit and bless us!

The new highly publicized anti-spam laws in Virginia are just another load of dirt meant to bury small business-people on the Web. What should we do about it? Nothing! Just take the hit and step up!

You see, the 'dirty' law being dumped on us, is actually our friend. It frightens our competitors into anti-spam positions and leaves Bulk-it the only bulk mail 'game in town'. The more the law is publicized, the greater the value of our tutorials. People know the tremendous power of bulk mail and will gladly pay to learn how to send it safely.

In actual fact, the Virginia law is not bad. Something needs to be done about the real spammers on the Net....the pornographers, scamsters, and those who use unethical mailing practices. Once these people are controlled, the arguments of anti-spam advocates will lose credibility and the pressure on legitimate Internet business will abate.

Here's what DEAA President Dan Hufnal says about the legislation:

"Responsible companies do not behave in this fashion. They proudly give the source of their advertising. They give netizens a chance to remove themselves from bulk email lists. We hope that this court decision along with the passage of the Murkowski Amendment sends a clear signal to those people who abuse the privilege of internet communications. There is no place for fraud or deception in this business. Throw the scoundrels out."

He is so right!

But the Virginia law has very little teeth. It is nearly impossible to enforce. The pornographers operate from hidden offshore servers that even the most talented hackers can't seem to locate and attack. If they can't do it, what chance does any Government have?

The Virginia Law is NOT aimed at the type of ethical, responsible, email that we send out, even though AOL, Microsoft and the anti-spam fanatics would like to make us think it is. 

In fact, the legislation was enacted to combat misleading emails, not responsible commercial mail. It legislates against using subject lines that trick you into opening the email, but does not concern itself with legitimate business offers like: "FREE Booklet reveals secrets to success on the Web".

This doesn't conflict at all with our Bulk Mail tutorials. I despise trickery and misleading statements in either subject lines or body copy, and demand honesty and a high degree of ethics from all Bulk-it members.

So for legitimate Internet business people, the Law is good. It specifically supports the Bulk-it program as follows:

Any person who intentionally transmits or causes to be transmitted to a recipient an item of commercial electronic mail that includes an advertisement, will be liable to the recipient for civil damages unless the advertisement readily identifiable as promotional or distinctly indicates that it is an advertisement, and clearly and conspicuously states (a) the legal name, complete street address, working phone number and electronic mail address of the person transmitting the electronic mail or causing the transmission of the electronic mail and (b) a notice that the recipient may decline to receive additional electronic mail that includes an advertisement from the person transmitting or causing the transmission of the electronic mail and the procedures for declining such electronic mail.

In plain English, it means you can legally send bulk mail without any liability if it is clearly an Advertisement and contains your legal name, address, phone number, email address, and a way for the recipient to be taken off your list.

So don't let the threats and misrepresentations of the anti-spam terrorists frighten you from making a legitimate living on the Internet. Shake off the dirt and step up to even greater success with the full approval of the new Virginia anti-spam law!
